You must not use this Website, if you have any objection to any of these Website Standard Terms And Conditions.

You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website, shopping for items for personal use that are sold on the Website and not for purpose of resale or any other commercial use.

We reserve the right to refuse service, terminate accounts, and/or cancel orders at our discretion, including, without limitation, if we believe that customer conduct violates this Agreement.

With respect to Your Content, by displaying it, you grant Bamboo Underwear, Inc. a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be infringing on any third party’s rights. Bamboo Underwear, Inc. reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.

You hereby indemnify to the fullest extent Bamboo Underwear, Inc. from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms your use of the website or in connection with your account with or without your permission.

1. SEVERABILITY.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

1. VARIATION OF TERMS.

Bamboo Underwear, Inc. is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

1. SUBSCRIPTION.

We will automatically renew your Subscription on your Anniversary Date. After that, we will automatically renew your Subscription on your Subscription Date each month and, as authorized by you when you consent to process your Subscription during the purchase process, we will charge your credit card with the applicable Subscription fee with taxes.

You may modify or cancel your subscription in your account in the “subscription” section and all such requests must be received at least one (1) day before your Subscription Anniversary Date and any such requests received after such date shall take effect the following month.

1. GIFT CARD.

Gift card ordered through our Website will be delivered automatically by electronic means to the email address you specify at the time of order.  Our eGift cards include unique PIN. You can buy for any value between $25 and $250 US. When ordering a Gift card, you should ensure to enter the recipient’s email address correctly.  We cannot be held responsible if the address is entered incorrectly and someone other than the intended recipient uses the Gift card. You can check the balance of the Gift card by logging into your account in the section “Gift card balance”.

Others rules:

– Gift card cannot be exchanged for cash.

– Gift card may only be redeemed against products purchased in the same currency as the Gift card.

– We are not responsible and not liable if a Gift card is lost, stolen or used without permission.

– Gift card can only be use for personal or business gifts.

Our Gift card must be redeemed on our Website, as full or part payment of Bamboo products from our Website.  A Gift card cannot be used to purchase a further Gift card.

1. ASSIGNMENT.

Bamboo Underwear, Inc. shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, .you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

1. ENTIRE AGREEMENT.

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire final and exclusive agreement between Bamboo Underwear, Inc. and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same. This agreement will survive the termination of your relationship with Bamboo Underwear.

1. GOVERNING LAW & JURISDICTION.

These Terms will be governed by and construed in accordance with the laws of Canada and you submit to the exclusive jurisdiction of the province of Quebec for the resolution of any disputes.

     15. MOBILE TERMS OF SERVICE

By consenting to BAMBOO Underwear’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of BAMBOO Underwear through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other BAMBOO Underwear mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
